1. Acceptance of Terms

The service provided by TheCaption.pro (hereafter referred to as "the Tool", "the Site", or "We") is subject to the following Terms of Service. Whether you are a casual creator making YouTube Shorts or a professional marketer crafting Instagram Reels, your use of our AI-driven features constitutes a legal agreement between you and TheCaption.pro.

2. Description of Service

We provide a browser-based AI tool that generates synchronized captions for videos. Our tool is specifically optimized for short-form content such as Instagram Reels and YouTube Shorts. We offer both a limited free version and a paid PRO version for $4.99. We do not provide video hosting; we provide a rendering tool that operates within your browser environment using client-side AI processing.

3. Modification of Service

WE CAN CHANGE ANYTHING ANYTIME: We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that TheCaption.pro shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service. This includes changes to our font styles, rendering speed, and video length limits.

4. User Responsibilities & License Keys

Upon purchasing a PRO plan, you will receive a unique license key. You are solely responsible for maintaining the confidentiality of your key. You agree that:

• You will not share your license key with others or use it on more than one machine simultaneously.
• We are NOT RESPONSIBLE if your key is lost, misused, stolen, or shared by your mistake or a third party's action.
• Any unauthorized use of your key may lead to immediate termination of service without a refund.

5. Content Liability Disclaimer

When you upload videos to generate captions for YouTube Shorts or Instagram Reels, you represent that you own the rights to that content. We are not responsible for the content of the videos processed through our tool. We do not preview, monitor, or edit your videos. You are solely liable for any copyright infringement or policy violations on social media platforms. We are "savers by law" as we do not store your video data on our servers; the processing is local.

6. No Warranty & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS". To the maximum extent permitted by law, TheCaption.pro disclaims all warranties, express or implied. We do not guarantee that our AI captions will be 100% accurate or that they will result in viral success for your Instagram Reels. We are NOT LIABLE for any loss of profit, data, or reputation. If our tool fails to render a video or if your browser crashes, we are not responsible for the loss of that creative session.

7. Payment & Refunds

All payments are handled securely through Lemon Squeezy. As per our Refund Policy, all sales of digital goods are final. Since our tool is used to generate immediate value for YouTube Shorts and Reels, we do not offer refunds once a license is activated. For billing issues, email contact@thecaption.pro.

8. Termination

We reserve the right to ban any user who attempts to reverse-engineer our code, scrape our data, or use our service for illegal purposes. In such cases, no prior notice or refund will be given.
